Free Guest Wi-Fi — Terms of Use

These Terms of Use ("Terms") govern your access to and use of the free wireless internet service ("Service") provided by Hawkesbury Motorcycles Holdings Pty Ltd T/AS Hawkesbury Motorcycles (ABN 16 685 196 776) ("we", "us", "our") at our premises.

Version 1.0 — effective July 2026.

1. The Service

The Service is provided free of charge as a convenience to our customers and visitors while on our premises. We do not guarantee that the Service will be available at any particular time, or that it will be uninterrupted, secure, error-free, or of any particular speed, coverage or quality.

We may limit, filter, restrict, suspend or withdraw the Service (in whole or in part, or for any user) at any time without notice. We may also impose session time limits, bandwidth limits or content restrictions.

2. Who may use the Service

The Service is intended for customers and visitors of Hawkesbury Motorcycles while at our premises. If you are under 18, you may only use the Service with the consent and under the supervision of a parent or guardian, who is responsible for your use.

3. Acceptable use

You must use the Service lawfully and responsibly. When using the Service you must not:

• use it for any unlawful purpose, or in a way that breaches any applicable law, regulation or code, or the rights of any person;
• access, download, store, send or publish material that is illegal, obscene, defamatory, discriminatory, threatening, harassing or otherwise objectionable;
• infringe copyright or other intellectual property rights, including by unauthorised downloading, streaming or sharing of films, music, software or other content (including via peer-to-peer or torrent services);
• attempt to gain unauthorised access to, interfere with, or disrupt any network, system, device or data (including ours or those of other users);
• introduce or transmit viruses, malware or other harmful code, or send spam or other unsolicited bulk communications;
• impersonate any person, misrepresent your identity, or bypass or attempt to bypass any authentication, filtering or security measure we apply;
• use the Service for commercial resale, or consume excessive bandwidth in a way that degrades the Service for others.

We may suspend or terminate your access immediately and without notice if we reasonably believe you have breached these Terms, and we may report unlawful activity to law enforcement or other authorities.

4. Security — use at your own risk

The Service is a shared, public wireless network and is not secure. Information you send or receive over the Service may be capable of being intercepted by third parties. You should not transmit sensitive information (such as banking details or passwords) over the Service unless you are using appropriate encryption (for example, secure websites or a VPN).

You are responsible for the security and configuration of your own device, including up-to-date antivirus software, a firewall and any other protections. To the extent permitted by law, we are not responsible for any damage to, or compromise of, your device, software or data arising from your use of the Service.

5. Privacy and monitoring

When you use the Service, we (or our service providers) may collect technical and usage information such as your device identifier (MAC address), device name, connection times, session duration, and volume of data used. If sign-in is required, we may also collect the details you provide (for example, your name or email address).

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and with our Privacy Policy. We may use collected information to operate, secure and improve the Service, and we may filter or monitor network traffic for security, compliance and network-management purposes. We may disclose information where required or authorised by law, including to law enforcement agencies.

6. Third-party content

The Service provides access to the internet, which contains content that we do not control. We are not responsible for any content, websites, services or transactions you access or enter into using the Service, and any filtering we apply is not a guarantee that particular content will be blocked or safe.

7. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

Subject to the paragraph above, the Service is provided "as is" and "as available", and we exclude all other guarantees, warranties, representations and conditions, whether express or implied. To the extent our liability can be limited, our total liability in connection with the Service is limited to supplying the Service again, and we are not liable for any loss of data, loss of profits, or any indirect or consequential loss arising from your use of, or inability to use, the Service.

8. Your responsibility to us

You are responsible for your use of the Service and agree to compensate us for any loss, damage, cost or claim we reasonably incur that arises from your breach of these Terms or your unlawful use of the Service, except to the extent we caused or contributed to it.

9. Changes to these Terms

We may update these Terms from time to time. The current version will be displayed at the point of connection (or available on request at our premises). Your continued use of the Service after changes are published means you accept the updated Terms.

10. General

These Terms are governed by the laws of New South Wales, Australia. If any part of these Terms is found to be invalid or unenforceable, the remaining parts continue in full force.
